EuroISPA Letter to EU Council Intellectual Working Party on Satellite & Cable Regulation

Brussels, 10 January 2018- In the context of upcoming inter-institutional negotiations on the so-called "Satellite and Cable Regulation", in December EuroISPA sent a letter to the EU Council Intellectual Property Working Party.

Following the adoption of the EU Council's general approach, EuroISPA strongly urges the EU Council to press for a wide and technologically neutral scope for the country of origin principle, and to resist the European Parliament proposal to include problematic 'direct injection' principles.

The letter underlines concerns over the reduced scope of the country of origin principle, which could hamper the development of the European digital content market. Furthermore, provisions inserted by the European Parliament on "direct injection" run counter to recent jurisprudence in this area, as well as being burdensome for operators which would fall under the widened scope.

In its letter, EuroISPA calls for a measured approach in trilogue negotiations on the Satellite and Cable Regulation, in order to support a strong European audio-visual content industry with a future-looking regulatory system and clarity for European Internet Service Providers.
