
e-Evidence Regulation: Closing the implementation gap before August 2026
EuroISPA welcomes the objectives of the EU e-Evidence Regulation (EU) 2023/1543 and its accompanying Directive (EU) 2023/1544, establishing an efficient and rights-respecting framework for cross-border access to electronic evidence. As the application date of 18 August 2026 approaches, EuroISPA calls on the European Commission to act pragmatically and ensure the Regulation is workable in practice, not merely enforceable on paper. This position paper documents a systemic readiness gap across the EU and sets out targeted recommendations on enforcement timing, IT system delivery, scope clarification, and the protection of providers acting in good faith.

EuroISPA contribution to the Targeted initiative to support the CDSM review process
EuroISPA welcomes the European Commission's targeted initiative to review the Copyright in the Digital Single Market Directive (CDSM Directive), which represents an important opportunity to ensure that copyright law is fit for the digital age. While sharing the Commission's commitment to an effective and future-proof copyright framework, EuroISPA urges that any policy response be proportionate, evidence-based, and directed at actors who have the practical ability to act. EuroISPA's contribution addresses three areas of direct relevance to its members: the challenges posed by network-level blocking in the context of online piracy, the implications of generative AI for the text and data mining framework established by Articles 3 and 4 of the CDSM Directive, and the need for greater harmonisation of the private copying exception.

EuroISPA Position Paper on the CSAM Regulation
EuroISPA welcomes the objective of the proposed CSAM Regulation, establishing an effective and rights-respecting framework to prevent and combat child sexual abuse material online. As trilogue negotiations continue, EuroISPA calls on the European Commission and co-legislators to ensure the final text is coherent with existing EU law, not merely protective in intent but workable for the providers expected to apply it. This position paper sets out targeted recommendations on encryption safeguards, a stable legal basis for voluntary detection, regulatory coherence with the DSA and other EU instruments, and the protection of providers acting in good faith.
